Terms and Conditions of Service
Access to and use of Tutors4You website, or any link to the Scribblar.com platform provided by any tutor from Tutors4You to the Student (including any on-line program, training material and tutorials) (‘the Service’) within the US, and internationally is provided by Tutors4You Inc. (‘we’, ‘us’ or ‘our’) on the following Terms and Conditions.
By using the Service you agree to be bound by these Terms and Conditions, which shall take effect immediately on your first use of the Service. If you do not agree to be bound by all of the following Terms and Conditions please do not register, access, use and/or contribute to the Service.
1. Services to be Performed.
Service (2-hrs, 5-hrs, 10-hrs, 20-hrs or any custom package of tutoring hours) consists of regularly scheduled tutoring sessions depending on the tutoring package chosen at registration, with an assigned Tutor online lasting anywhere between 1 hour and 2 hours per session depending upon the student's availability, and ability level. Tutor will provide instruction and strategies to the Student. Tutors4You strongly encourages the Student to diligently perform necessary assignments to optimize Student success. The 2-hrs, 5-hrs, 10-hrs, 20-hrs or any custom package of tutoring hours is considered completed and satisfied in full when any of the following occurs first:
a) Student has received up to 2-hrs, 5-hrs, 10-hrs, 20-hrs or any custom package of tutorial sessions according to the Service registered.
b) Student has been tutored for one calendar year starting from the date of registration. There is no refund for the number of hours remaining after one calendar year from the start date.
2. Tutoring Policies
Student Responsibilities
To achieve optimal success in any of our programs, Tutors4You highly recommends that Students consistently follow the pertinent activities outlined below:
a) A minimum of 30 minutes of consistent and thorough DAILY study time from the topic the student asked help on.
b) Optimal nutrition within one hour of beginning each session or practice test.
c) Striving for a minimum of 80% compliance toward the overall concepts and practice exercises worked out with the Tutor.
d) Student must complete all homework assigned prior to tutoring. If Student does not have his or her homework completed, Tutor will ask Student to complete it during the tutoring session, retarding progress.
e) Student is encouraged to be alert, energized, confident, and focused during each of the sessions.
f) Student must actively participate in the tutoring session, and must be prepared to work with all required materials.
Parent/Guardians/Students clearly understand Tutors4You success protocols described above.
3. Cancelation of Session Policy.
Our tutors are always in high demand and have busy schedules, but they will do their best to accommodate the student’s schedule. We fully understand the commitment placed on academic and athletic demands on today’s students. In the same spirit, we ask for common courtesy. Tutors4You requires that our sessions be kept once they are scheduled. If you can no longer keep a scheduled session, please contact your tutor or Tutors4You by phone, email, or text message at least 24 hours in advance of the scheduled session. Tutors4You must charge a full session fee for any cancellation made within 24 hours of the scheduled session. Please keep your student’s academic and extracurricular schedule in mind when scheduling our tutoring sessions. Please note that non-emergency related events such as sports practices, guests or family dinners, “lots of homework,” etc., are not acceptable excuses for canceling a session within 24 hours. If you must cancel a session within the 24 hours timeframe of a scheduled session, Tutors4You will consider the session rendered.
Oversight Forgiveness
Tutors4You understands that life is unpredictable and sometimes it is not possible to anticipate a circumstance that de- rives in a cancelation of a tutoring session. This is why Tutors4You provide 2 (two) oversight forgivenesses during the lifetime of this Agreement. This means that if Parent/Guardian fails to cancel or reschedule a session according to the Cancelation and Session Policy described in item 3, Parent/Guardian will not be charged for that session.
4. Parent/Guardian Responsibilities.
Parent/Guardian understands that Tutors4You has made a commitment to provide their services in accordance with all the terms under this Agreement. Parent/Guardian understands that they are responsible for what occurs in their home and release and hold harmless Tutors4You and its owner, and its representatives from all claims, demands, damages, or costs, which result from the provision of this service.
5. Payment
Payment for any of the test prep programs is billed in US dollars; and student’s or parent’s financial institutions may charge a fee for conversion to local currency. Each program can be paid in full or monthly payments according to the options given on the registration page. Your credit/ debit card details are not handled by Tutors4You. All payment and all credit card handling is through the third party, Stripe or PayPal Inc. We do not store any credit card details. Authority for payment must be given at the time of placing your order. The Service will be made available to you once your payment has been authorized.
6. Dishonored Payment and Past Due Invoices
If initial or subsequent Parent/Guardian payment is past due or declined, Tutors4You reserves the right to suspend or terminate any remaining sessions until payment is received. If payment is not received within 15 calendar days from the past due date or declined transaction date, Tutors4You considers the program abandoned and will terminate the contract. No refund will be given to Parent/Guardian on the unused hours. To reinstate the program, Parent/ Guardian must pay the balance in full of the remaining portion of the program within 5 calendar days from the termination notice. There will be a $40.00 fee for invalid credit card transactions, due at the time the dishonored payment is cleared. If Parent/Guardian does not pay the fee within 2 business days from the date the dishonored payment cleared, Tutors4You reserves the right to suspend lessons until the account is in good standing.
7. Termination of Services & Refunds
Cancellation and refunds are available for students registered online to one of the programs only within 15 calendar days of starting the program. The hours rendered until then will be calculated at $99 USD per hour. The difference minus a $65 USD processing fee will be returned to the student. Please note Tutors4You is unable to reimburse for any currency conversion fees charged by the credit-card issuer or any other related transaction fees charged by the merchant, and refunds will be issued to the paying credit card. There will be no refunds given for students who request a refund outside of these parameters. If you need to request a refund for whatever reason please contact support@tutors4you.net.
8. Materials.
Student must provide all of the course materials necessary for the success of the tutoring session. The Tutor can complement the Student’s material with additional worksheets or related content to maximize learning. It is the Student’s responsibility to correctly specify the content he or she needs help with. Tutors4You will not provide technology equipment to Student such as calculators, tablets, or computers. Tutors4You will not pay for any textbook, software, mobile apps, or any other required learning material that the Student need for his or her class.
9. Suspension of Sessions
If Parent/Guardian/Student decides to suspend a certain program and continue at a later time, Parent/Guardian/Student must notify Tutors4You in writing the Start and End date of the suspension of sessions. No scheduling of sessions will be made during this period. If Parent/Guardian/Student would like to resume sessions before the end of the suspended period, it will be at Tutors4You’s sole discretion to do so depending on Tutor availability and open tutoring spots. Parent/Guardian/Student understands that their regular tutoring schedule or frequency of sessions is not available while the suspended period is in effect. Tutors4You will try their hardest to accommodate Parent/Guardian/Student requests but makes no guarantee. If the student does not resume the sessions after the end of the suspended period, the program is considered abandoned and no further scheduling will be made. No refunds will be given for the unused portion of the program. Unused tutoring hours are also nontransferable to third parties, family members, or friends.
10. Privacy and Confidentiality
Parent/Guardian/Student acknowledges that it will be necessary for Tutors4You to disclose certain confidential and proprietary information to Parent/Guardian/Student in order for Tutors4You/Educational Tutor to perform his/her duties under this Agreement. Parent/Guardian/Student’s personal information will not be shared with any other third parties, except as necessary for the express purpose of payment processing for the services in this agreement from Tutors4You unless we are required to do so by law or a governmental regulatory authority. Tutors4You will not give or sell your nonpublic personal information provided on this form to any other company, individual or group. Accordingly, Parent/ Guardian/Student will not disclose or use, either during or after the term of this Agreement, any Tutors4You proprietary or confidential information.
11. Non-Solicitation Agreement
By becoming a Tutors4You Inc. customer, Parent/Guardian agrees that Parent/Guardian will not hire, solicit for employment, or engage as an independent contractor, or permit any organization directly or indirectly controlled by Parent/ Guardian to hire, solicit for employment, or engage as an independent contractor, any person employed by Tutors4You Inc. at any time during the term of Tutors4You Inc.’s provision of services to Parent/Guardian. Any additional services desired of a Tutors4You Inc. instructor may be requested through Tutors4You Inc. by e-mail at support@tutors4you.net. Be advised that all of Tutors4You instructors have signed a Non-Compete Agreement, with severe penalties to discourage independent soliciting of their services.
12. Intellectual Property Ownership
Student/Parent/Guardian understands that Tutors4You owns all intellectual property of any proprietary material handed to the Student by the Tutor. Parent/Guardian/Student agrees not to use, sell, or share in any way any of the copyrighted or proprietary materials for the benefit of any other party without Provider's (Tutors4You) prior written permission. Furthermore, Tutors4You has the right to publish Student/Parent/Guardian testimonials and any results from standardized tests (SAT, ACT, PSAT, IOWA, SSAT, FCAT) or improved GPA.
13. Exchanging Tutor(s)
For consistency, Tutors4You will make every effort to keep the same Tutor/Student paired up throughout the Tutors4You contracted service. There may be circumstances, however, that require an alternate Tutor to be provided. Those circumstances include, but are not limited to health issues, scheduling issues, etc. Additionally, if the Student is other than complying with the terms of this agreement and performing poorly during the Tutors4You contracted service, a new Tutor may be assigned at the discretion of Tutors4You.
14. Disclaimers and Limitation of Liability
ALL CONTENT PROVIDED ON OR THROUGH THE SERVICE, INCLUDING THE INFORMATION, NAMES, IMAGES, PICTURES, LOGOS AND ICONS REGARDING OR RELATING TO TUTORS4YOU INC., ITS PRODUCTS AND SERVICES (OR TO THIRD PARTY PRODUCTS AND SERVICES), IS PRO- VIDED "AS IS" AND ON AN "AS AVAILABLE" BASIS. TO THE EXTENT PERMITTED BY LAW, TUTORS4YOU INC. EXCLUDES ALL REPRESENTATIONS AND WARRANTIES (WHETHER EXPRESS OR IMPLIED BY LAW), INCLUDING THE IMPLIED WARRANTIES OF SATISFACTORY QUALITY, FIT- NESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, COMPATIBILITY, SECURITY AND AC- CURACY. TUTORS4YOU INC. DOES NOT GUARANTEE THE TIMELINESS, COMPLETENESS OR PERFORMANCE OF ANY ASPECT OF THE SERVICE OR ANY OF ITS CONTENT. WHILE WE TRY TO EN- SURE THAT ALL CONTENT PROVIDED BY TUTORS4YOU INC. IS CORRECT AT THE TIME OF DE- LIVERY OF THE SESSIONS NO RESPONSIBILITY IS ACCEPTED BY OR ON BEHALF OF TUTORS4YOU INC. FOR ANY ERRORS, OMISSIONS OR INACCURATE CONTENT ON THE SERVICE.
NOTHING IN THESE TERMS AND CONDITIONS LIMITS OR EXCLUDES TUTORS4YOU INC.'S LIA- BILITY FOR DEATH OR PERSONAL INJURY CAUSED BY ITS PROVEN NEGLIGENCE. SUBJECT TO THE PREVIOUS SENTENCE, NEITHER TUTORS4YOU INC. NOR ANY OF ITS OFFICERS OR EMPLOYEES SHALL BE LIABLE FOR ANY OF THE FOLLOWING LOSSES OR DAMAGES (WHETHER SUCH DAMAGE OR LOSSES WERE FORESEEN, FORESEEABLE, KNOWN OR OTHERWISE): (A) LOSS OF DATA; (B) LOSS OF REVENUE OR ANTICIPATED PROFITS; (C) LOSS OF BUSINESS; (D) LOSS OF OPPORTUNITY OR ANTICIPATED SAVINGS; (E) LOSS OF GOODWILL OR INJURY TO REPUTATION; (F) LOSSES SUFFERED BY THIRD PARTIES; OR (G) ANY INDIRECT, CONSEQUENTIAL, SPECIAL OR EXEMPLARY DAMAGES ARISING FROM THE USE OF THE SERVICE REGARDLESS OF THE FORM OF ACTION.
TUTORS4YOU INC. DOES NOT WARRANT THAT FUNCTIONS AVAILABLE ON OR THROUGH THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR BUGS. YOU ACKNOWLEDGE THAT IT IS YOUR RESPONSIBILITY TO IMPLEMENT SUFFICIENT PROCEDURES AND VIRUS CHECKS (INCLUDING ANTI-VIRUS AND OTHER SECURITY CHECKS) TO SATISFY YOUR PARTICULAR REQUIREMENTS FOR THE ACCURACY OF DATA INPUT AND OUTPUT.
15. Applicable Law
These Terms and Conditions will be subject to the laws of the State of Florida. We will try to solve any disagreements quickly and efficiently. If you are not happy with the way we deal with any disagreement and you want to take court proceedings, you must do so within the State of Florida.
16. International Use
We make no promise that materials available on or through the Service are appropriate or available for use in locations outside the United States, and accessing the Service from territories where its contents are illegal or unlawful is prohibited. If you choose to access the Service from locations outside the United States, you do so on your own initiative and are responsible for compliance with local laws.
17. Exclusive Agreement
This is the entire Agreement between Provider and Parent/Guardian/Student. It cannot be transferred to any third-party, family member, friend, or relative.
